1. IDENTITY AND ADDRESS OF THE CONTROLLER
This Privacy Notice (hereinafter “Notice”) establishes the terms and conditions under which ABC Art Baja (hereinafter “ABC Art Baja”), with registered office at Aristóteles 92, Col. Polanco 11560, Mexico City, in its capacity as Controller, will process the personal data that concerns you as the owner of personal data, in order to protect your privacy and your right to informational self-determination, as provided for in the Federal Law on the Protection of Personal Data Held by Private Parties (the “LFPDP”), its Regulations and the Privacy Notice Guidelines issued by the Ministry of Economy (hereinafter the “Ordinances”).

For the purposes of this Notice, the definitions of the terms “Personal Data”, “Sensitive Personal Data”, “Days”, “Processing”, “Data Owner”, “Controller”, “Processor”, “Transfer”, “ARCO Rights” – “Right of Access”, “Right of Rectification”, “Right of Cancellation”, “Right of Opposition”; “Cookies”, “Web Beacons”, as well as the other elements provided for in the Notice, will have the same meaning as that attributed to them in the Ordinances.
3. PERSONAL DATA THAT WE COLLECT AND PROCESS
ABC Art Baja collects and processes the personal data listed below:
A. Guests, Prospects, Clients and Exhibitors
to) Identification data
Full name, full address, landline (home or office), cell phone, email, photograph, video image and audio voice.
b) Data to access ABC Art Baja services
Key and user number managed on the website of ABC Art Baja located at www.abcartbaja.com to access our online services.
c) Tax data
Key and Folio of the Federal Taxpayers Registry key, as well as tax address.
d) Data linked to credit and/or debit cards
Personal data related to your payment method: name of the Card holder, credit and/or debit card number, expiration date, card type and security code, CLABE, bank account number and bank of origin.

4. PURPOSES
ABC Art Baja processes your personal data in order to carry out activities and actions aimed at fulfilling the obligations arising from and derived from any cultural, commercial and/or legal relationship that we establish with you and which constitute primary purposes, as set out below:
i) Register in their databases and directories of guests, prospects, clients, and/or exhibitors;
ii) Register you in its temporary database of guests, prospects, clients and/or exhibitors;
iii) Register you in its visitor database;
iv) Manage and administer events;
v) Monitor and control your access to events;
vi) Manage your security at the events you hold ABC Art Baja, through video recording of activities and management of security incidents;
vii) Facilitate the sending of invitations from our clients and/or exhibitors to their guests for the events of ABC Art Baja;
viii) Create your event access badge;
ix) Manage the sending of badges to your home;
x) Manage payment for services via credit card and other means of payment;
xi) Manage user names and passwords to authenticate the identity of exhibitors and VIP visitors, in order to allow them to use the online services and their tools, including the Exhibitors Manual;
xii) Carry out the administrative management of the event – payments, technical assistance and operations, and
xiii) Prepare and deliver tax receipts.
Additionally, we will process your personal data for other secondary purposes, which do not give rise to or are not necessary for the legal relationship that we establish with you, as set out below:
i) Send you newsletters and information via print and electronic media about events, invitations, promotions, services and products of ABC Art Baja, as well as other art fairs in Mexico and/or abroad – or from suppliers, exhibitors and/or sponsors that we estimate may be of interest to you;
ii) Send you communications for marketing, advertising or commercial prospecting purposes related to the events of ABC Art Baja, whether through print or electronic media, and
iii) Conduct market research and for statistical purposes.
In the event that you do not wish for your personal data to be processed for commercial prospecting purposes, you may send a Request for Limitation of Processing of Personal Data to the email address info@abcartbaja.com. The refusal to the secondary processing of your personal data will not be a reason for us to refuse the processing of your personal data. ABC Art Baja deny the provision of services.
In any case, you can limit the use and disclosure of your personal data by registering in the Public Registry to Avoid Advertising run by the Federal Consumer Protection Agency.
5. DATA TRANSFERS TO THIRD PARTIES
ABC Art Baja will not make any transfer of your personal data to third parties, both inside and outside the United Mexican States.
6. PROCEDURE FOR EXERCISING ARCO RIGHTS AND REVOCATION OF CONSENT
At all times, you have the right to access, rectify, cancel your personal data, as well as to oppose the processing of the same or revoke your consent regarding the processing for all or certain purposes that you have previously authorized, rights that are known as ARCO rightsYou can exercise these rights either personally or through your legal representative. To do so, you must submit the corresponding application with the following information and documentation:
- Your full name, as well as your address or means (such as your email) to be able to communicate with you regarding your request;
- Documents proving your identity, such as a simple copy of your voter ID, passport or visa (as applicable), or, where applicable, those of your legal representative, in addition to the simple power of attorney with your autograph signature and that of two witnesses, along with the official identification of each of those involved;
- Clear and precise description of the personal data regarding which you wish to exercise any of the ARCO rights;
- Any other document or item to facilitate the location of your personal data.
Process for requests for access to personal data: If you request access to your personal data, ABC Art Baja will proceed with the delivery of said information, preferably electronically, once your identity or that of your legal representative has been verified, as appropriate.
For requests for data rectification: In addition to indicating what data you wish to modify, you must provide documentation to support your request.
Response time: ABC Art Baja will respond to you within a maximum period of 20 days from the date of receipt of your request (whether for access, rectification, cancellation or opposition). If the request is admissible, it will become effective within 15 days from the date of notification.
The response will be sent by the same means in which you submitted the request, or by another means agreed upon with you. The deadlines may be extended once for an equal period, if the circumstances justify it, in accordance with the provisions of the Federal Law on the Protection of Personal Data Held by Private Parties (LFPDP).
Application cost: The delivery of physical media containing the data requested for the exercise of the right of access will be free of charge. However, if costs are generated for concepts such as shipping or reproduction in other formats, these will be your responsibility. If you make recurring requests within a period of less than 12 months, you may be charged the corresponding costs, unless there are substantial changes to the privacy notice.

Request for additional information: If the information provided in your application is incorrect or incomplete, or if the required supporting documents are not included, ABC Art Baja may request you, within 5 days of receiving your application, to provide the missing items or documents. You will have a period of 10 days to process our request, starting on the day after you receive it. If you do not respond within this period, the request will be considered not submitted.
